About the Seminar
Bringing together top criminal law practitioners and speakers from throughout the state, the Annual Criminal Practice in South Carolina seminar is back for its 24th year to provide you with the very best review of substantive and procedural criminal law, ethical and strategic considerations for criminal law practitioners, and issues related to immigrant crime victims, witnesses, and defendants.

South Carolina speakers serving on this year’s distinguished faculty are Amie L. Clifford, Salley W. Elliott, Honorable John Cannon Few, Honorable Ernest A. Finney, III, Honorable Thomas E. Pope, Patricia S. Ravenhorst, Andrew J. Savage, III, Barbara M. Seymour,Tara Dawn Shurling, and Hervery B. O. Young.

In addition to presentations from these South Carolina lawyers, this year’s program will include presentations by noted Arizona criminal defense lawyer Robert J. McWhirter, author of the American Bar Association’s publications, The Criminal Lawyer’s Guide to Immigration Law: Questions and Answers, 2nd Ed. (2006), and The Citizenship Flowchart (2007). In Padilla v. Kentucky, 559 U.S. 356 (2010), the Supreme Court of the United States extensively quoted from Mr. McWhirter’s book in Justice Alito’s concurring opinion.  Padilla holds that the Sixth Amendment requires defense counsel to inform a client whether his or her guilty plea carries a risk of deportation. The immigration consequences of criminal convictions have become progressively more severe over time and, after Padilla v. Kentucky, the duties of both lawyers and  judges to warn aliens of collateral consequences are more pronounced.  Mr. McWhirter’s talk explores those duties and,  using Dante’s Rings of Hell as an organizational device, outlines the different immigration consequences for aliens for given criminal convictions.
